On the 29th of last month, a post titled "Please look at the woman who is breaking off her engagement because my dad is a violent criminal" was uploaded on an online community, Nate Pann.

The writer B, who identified herself as the younger sibling of her brother A who was broken off with, said, "(My brother) A recently decided to marry his girlfriend after dating for six years," adding, "He prepared a rental house, booked a wedding hall, and even made wedding invitations as part of the wedding preparations." However, before the wedding, A confessed to his girlfriend C about his father's violent criminal record. The father was sentenced to prison in 1997, served 25 years, and was released in 2022. After hearing this, C notified A of the breakup shortly thereafter.
B said, "I won't specify what crime (my father) committed," and expressed frustration, saying, "My brother has nothing to do with my father's crime. But that woman, after gathering courage to tell him, suggested breaking off the marriage." She added, "My brother said that six years of dating felt meaningless." B further explained, "I wrote this post to ask if we can claim damages and compensation from that woman," expressing anger, "We spent money on the wedding hall, wedding invitations, and even the apartment rental deposit. Do you think that’s a small amount?"
Most netizens responded coldly to the post, saying things like, "Jo Doo-soon was sentenced to 12 years," "If she hadn’t told him beforehand, it could have been marriage fraud," and "If my daughter had to eat with such a father-in-law, I wouldn’t tolerate it." However, the post was originally published on Nate Pann, and the authenticity of the story has not been verified.
Article 801 of the Civil Act of the Republic of Korea defines 'engagement' as a promise of marriage. According to this provision, if an engagement contract, agreement, or promise made by mutual consent between the parties is unilaterally refused without just cause, resulting in the cancellation of the engagement, claims for damages and restitution of unjust enrichment are possible. However, under the Civil Act, ▲if one is sentenced to disqualification or higher after engagement ▲if a judgment for commencement of adult guardianship or limited guardianship is made after engagement ▲if one has a venereal disease, incurable mental illness, or other incurable disease ▲if one becomes engaged or married to another person after engagement ▲if one’s whereabouts have been unknown for more than one year after engagement ▲if one commits adultery with another person after engagement, these are considered valid reasons for breaking off an engagement. Additionally, deception regarding the other party’s academic background, occupation, or financial status, serious insults, assault and verbal abuse, loss of affection, verbal abuse from parents-in-law, and conflicts over wedding gifts also constitute valid reasons for breaking off an engagement.
