Mr. A was indicted on charges of identity theft after being caught driving without a license under the influence on a road in Jinhae-gu, Changwon-si, Gyeongnam Province, in September last year, during which he gave his older sister's resident registration number and signed as her. At that time, Mr. A's blood alcohol concentration was 0.141%, which is at the license cancellation level.

Mr. A had also received a summary order for a fine for drunk driving in 2016. The court stated, "The blood alcohol concentration was high at the time of the crime, and the defendant deceived the investigative authorities by signing as if he were his older sister during the drunk driving crackdown, making the guilt very serious. However, we took into account that he revealed the identity theft to the investigative authorities and is deeply reflecting on his actions," explaining the sentencing rationale.

The court stated, "Mr. A committed this crime again despite multiple prior criminal punishments. Considering the relatively high blood alcohol concentration at the time, the circumstances of the drunk driving, the situation after the crime, and the criminal record comprehensively, the sentence is determined," the court ruled.
