Reduced to 8 Years in Prison on Appeal Due to Intellectual Disability Consideration
A man in his 20s who lured a 4-year-old girl, gave her milk mixed with sleeping pills, and committed sexual acts was given a reduced sentence in the appellate court.
According to the legal community on the 23rd, the Criminal Division 1 of Daegu High Court (Chief Judge Jin Seong-cheol) recently overturned the original sentence of 10 years imprisonment for Mr. A (27), who was indicted and detained on charges including violation of the Act on the Aggravated Punishment of Specific Crimes, and sentenced him to 8 years imprisonment.

Additionally, he was ordered to wear an electronic tracking device (electronic anklet) for 20 years and was banned from employment at institutions related to children, adolescents, and persons with disabilities for 10 years.
Mr. A went to his usual church on December 4 last year, and when there were no girls there, he went to another church and approached Ms. B (4), who was separated from her guardian. He lured her by saying, "There is a sick cat in my car," and took her to his home. He then gave her strawberry milk mixed with a hypnotic sedative and sexually abused her, leading to prosecution.
Investigations revealed that Mr. A developed sexual desire upon seeing a young girl at his church and had prepared tools himself with the intent to commit the crime.
During the trial, Mr. A claimed diminished mental capacity. The first trial court rejected this claim and sentenced him to 10 years imprisonment.
The first trial court stated, "He lured Ms. B, who was only 4 years old, to consume a hypnotic sedative that should not be taken, and committed a bizarre and shocking crime using a syringe. Ms. B and her family will likely live in fear wherever they go, worrying that such an incident might happen again, thus strict punishment is necessary."
Dissatisfied with the ruling, Mr. A appealed on grounds of excessive sentencing and diminished mental capacity.

In response, the appellate court explained the reason for the reduced sentence, stating, "Although Mr. A has a level 3 intellectual disability and did not reach the degree of diminished mental capacity at the time of the crime, it is recognized that his responsibility is less than that of an average adult. He admitted his wrongdoing and showed potential for correcting his distorted sexual perception through reflection."
