Anesthesia Patient Sexual Assault Intern... Sentenced to 1 Year and 6 Months in Second Trial
A former intern at a large hospital, who was charged with sexually assaulting a female patient under anesthesia, was sentenced to imprisonment again in the appellate court.
On the 4th, the Criminal Appeals Division 3 of the Seoul Eastern District Court (Presiding Judge Heo Il-seung) sentenced Lee Mo (35), who was charged with quasi-forcible molestation, to 1 year and 6 months in prison, ordered him to complete 40 hours of a sexual violence treatment program, and imposed a 5-year employment restriction at institutions related to children, adolescents, and persons with disabilities.
The court stated, "It is difficult to see that the sentence in the first trial was excessively heavy or light, thus exceeding the reasonable range of sentencing discretion," and dismissed both the prosecution's and Lee's appeals.

The court also noted, "Lee was preoccupied with justifying his actions through various claims, showing no remorse or apology toward the victim, and the crime involved molesting a patient who was unable to resist due to anesthesia, which reflects a very serious nature of the offense," but added, "It is difficult to view the crime as having been committed with malicious intent or meticulous planning, and it appears to have been an act of failing to control a momentary impulse."
