Went to Parents' Home for the Holiday... Sexual Offender Who Violated Curfew and Drank Alcohol Receives Fine
Violation of outing restrictions and alcohol ban orders with electronic device attached
A sex offender who was granted an exception to the curfew order to stay at his family home during the holiday broke his promise and wandered the streets late at night, resulting in a fine.
According to the legal community on the 28th, the Seoul Northern District Court Criminal Division 1 (Presiding Judge Shin Sang-ryeol) sentenced Mr. A, a man in his 40s, who was indicted for violating the Electronic Monitoring Act, to a fine of 10 million won on the 20th.
Mr. A was convicted of sex crimes in 2007, 2016, and 2018, respectively, and was released after serving his sentence in May last year. He was required to wear an electronic monitoring device until March 30 of next year. During this period, he was subject to a curfew from 1 a.m. to 5 a.m. daily, but the curfew was adjusted on the condition that he stay at his family home during the Lunar New Year holiday from January 18 to 23.
However, on January 21 at around 1:04 a.m., Mr. A was found to have left his family home in Eunpyeong-gu, Seoul, and was near his residence in Dobong-gu, where he bought cigarettes at a convenience store and wandered for about 11 minutes. In July last year, he was also caught by an officer from the Seoul Probation Office for drinking beer with acquaintances late at night, violating the order not to have a blood alcohol concentration of 0.03% or higher. The breathalyzer test showed a blood alcohol concentration of 0.162%.

The court pointed out, "The defendant committed each of these offenses during the recidivism period and has a weak sense of compliance," adding, "He even used abusive language and threatening behavior toward the probation officer during the alcohol test." However, the court explained the sentencing rationale by stating, "He is reflecting on his crimes, the violation of the curfew lasted about 15 minutes and was not lengthy, and he was near his residence," and "He showed efforts to comply with procedures by applying for a temporary adjustment of the compliance conditions before the offense."
