"Your Mom Is Having an Affair with Me" 60s Man Exposes to Daughter After Mistress Cuts Contact

Suspended Sentence Verdict

A man in his 60s who exposed his affair to his lover’s child after his mistress cut off contact was sentenced to a suspended prison term.

The man also assaulted his mistress, causing injuries requiring two weeks of medical treatment.

According to the legal community on the 7th, Judge Lee Jong-min of the Criminal Division 3 at the Seoul Central District Court sentenced A (64), who was indicted for assault, battery, and violation of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., to 8 months in prison with a 2-year suspension and ordered 80 hours of community service.

In February 2021, A assaulted B, a woman in her 50s with whom he had an extramarital relationship, multiple times, causing injuries requiring two weeks of medical treatment, suspecting that she was seeing another man.

In March of the same year, when B did not respond to his calls, he called her daughter and said, “Your father also knows that your mother has a problem with men.” A is accused of sending text messages exchanged between him and B to her daughter.

He also sent multiple text messages to B’s daughter claiming that her mother had inappropriate relationships with men other than himself.

The prosecution judged A’s actions as “repeatedly delivering words, sounds, or images that cause fear or anxiety to the victim” and applied charges for violating the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.

Article 70 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. stipulates that “anyone who publicly reveals facts through an information and communications network with the intent to defame a person and damages another person’s honor shall be punished by imprisonment for up to three years or a fine of up to 30 million won.”

If the defamation is false, the penalty is imprisonment for up to seven years, disqualification, or a fine of up to 50 million won. According to Article 311 of the Criminal Act, anyone who publicly insults another person shall be punished by imprisonment or detention for up to one year or a fine of up to 2 million won.

The court recognized all charges as guilty and explained the sentencing by stating, “Although A assaulted B, he denied it, claiming he does not remember, and it appears that B’s daughter suffered mental harm due to his calls and messages.”
