Starting Today, ‘Imchagwondeunggi’ Can Be Completed Without Landlord Confirmation
From today, the safety device to protect jeonse deposits, called ‘imchakgwon deunggi’ (leasehold registration), can be done without the landlord's confirmation.
According to the Ministry of Land, Infrastructure and Transport on the 19th, the amended Housing Lease Protection Act, which passed the National Assembly at the end of March, will be enforced from this day. Imchakgwon deunggi refers to the application to the court by a tenant to maintain the right to recover the deposit when the landlord does not return the deposit at the end of a jeonse or monthly rent contract. Tenants who complete imchakgwon deunggi retain their opposability and priority repayment rights even after moving out.
Until now, the imchakgwon deunggi was completed only after confirmation that the court’s imchakgwon deunggi order decision was delivered to the landlord. If the landlord intentionally avoided delivery or passed away, it was difficult for the tenant to register the imchakgwon deunggi.

However, with the amendment of the Housing Lease Protection Act, once the court’s imchakgwon deunggi order is issued, the imchakgwon deunggi can be completed even before the landlord is notified of the decision. Even if the imchakgwon deunggi order was issued before the law’s enforcement, if it has not yet been delivered to the landlord as of this date, the amended law applies and the imchakgwon deunggi is considered completed. The improvement of the imchakgwon deunggi order system was originally scheduled to be implemented in October, but the enforcement date was moved up by three months due to the spread of jeonse fraud victims.
