"Complaints of 'Mom Won't Help with Homework'... Repeated Student Assault by Private Tutor Confirmed with Prison Sentence"
Law: "Not an accidental act or disciplinary measure"
A private tutor who habitually assaulted a student because the student's mother did not help with homework, causing delays in class progress, was sentenced to prison.
The Supreme Court's 3rd Division (Presiding Justice Oh Seok-jun) announced on the 2nd that it upheld the original sentence of 1 year and 4 months imprisonment for Mr. A, a man in his 20s, who was charged with habitual injury under the Child Abuse Punishment Act.
Mr. A was tried on charges of habitually assaulting a 13-year-old boy whom he tutored at a study cafe in Seoul for about a month starting from April last year.
Mr. A struck or kicked the student a total of 160 times over 10 occasions, hitting the cheeks, head, and chest, citing reasons such as the student not concentrating. The victim sustained injuries including cervical and rib sprains that required two weeks of treatment. He also took the student to the emergency stairs of the building to assault him after the study cafe usage time ended.
It was investigated that Mr. A committed the crimes after arguing with the student's mother, complaining that "the mother did not help with homework, causing delays in class progress," and harboring resentment toward both the student and the mother.

The first and second trials stated, "It is difficult to view Mr. A's assaults as impulsive acts or disciplinary measures," and sentenced him to 1 year and 4 months imprisonment. The Supreme Court also agreed with the lower courts' judgment.
