Supreme Court to Discuss Protection Measures for Tenants Victimized by Jeonse Fraud, Including 'Auction Date Postponement'
Regular Seminar for Judicial Assistants Held on the 27th
The Supreme Court recently held a seminar to protect tenants who have fallen victim to the serious social issue of Jeonse fraud, discussing practical measures such as 'postponement of auction dates.'
The Supreme Court announced on the 23rd that it will hold a regular seminar for judicial assistants on the 27th to conduct in-depth discussions on topics including 'Appropriate management measures for real estate auction practices to protect tenants affected by Jeonse fraud.'
Judicial assistants are court officials who play the role of judges in civil enforcement procedures such as auctions. The Supreme Court holds regular seminars for judicial assistants every year to discuss contentious issues by task or matters requiring uniformity in work, and has utilized the outcomes in practical operations.
Considering the recent surge in cases where tenants have been unable to recover their rental deposits due to Jeonse fraud and non-returned deposit houses (commonly known as Kkangtong Jeonse houses), the Supreme Court set this as the theme for the upcoming regular seminar.
At this seminar, topics to be discussed include ▲whether to postpone auction dates requested by tenants or creditors who are victims of Jeonse fraud ▲appropriate postponement periods and adjustment of the number of postponements in cases where auction dates are postponed, focusing on the proper management of real estate enforcement practices related to Jeonse fraud cases.
Additionally, ▲regarding the amendment of Article 3-3, Paragraph 3 of the Housing Lease Protection Act (effective from October 19), which allows the enforcement of tenant registration orders even before the landlord receives the tenant registration order, discussions will be held on follow-up measures such as revising related regulations in preparation for the implementation of the amended law and practical management methods aligned with the purpose of the legal amendment.
Earlier this year, the Supreme Court implemented improvement measures to strengthen the protection of rights for tenants affected by Jeonse fraud, including ▲allowing tenants to register housing lease rights under tenant registration orders even if they have not completed subrogation inheritance registration ▲simplifying the delivery procedure of tenant registration orders, thereby reducing the burden on tenants affected by Jeonse fraud and enabling them to promptly recover their rental deposits.

A Supreme Court official stated, "Through this regular seminar, we expect to prepare measures that can effectively protect tenants who have recently become a social issue in the areas of tenant registration orders and real estate auction work handled by judicial assistants, thereby somewhat aiding in the recovery of tenant damages and the stabilization of their housing life." He added, "The court will continue to make every effort to strengthen the protection of tenant rights."
