Victim's Mother "Says It Was Due to Lawyer's Scheduling Mistake"
It was belatedly revealed that lawyer Kwon Kyung-ae, co-author of 'Joguk Heukseo,' lost a damages claim lawsuit on behalf of a school violence victim after failing to appear in court three times.
Lee Gi-cheol, the mother of victim A, who entrusted the lawsuit to lawyer Kwon, revealed that due to the lawyer's absence, they are now facing the possibility of having to pay the defendant's litigation costs as well.
In an interview with MBC Radio's 'Kim Jong-bae's Focus' on the 6th, Lee said, "He (lawyer Kwon) said he couldn't attend the first time because he collapsed, and the second time he wrote the date incorrectly in his planner as the next day, so he missed it. Because he missed twice, the case was dismissed."
She continued, "But I found out it wasn't twice, it was three times. So, what was initially processed as a partial win in the first trial was changed to a loss, and the remaining (appeal) was processed as withdrawn."
Lee said that even after the lawyer's absence and loss became known through the media, she had not been contacted by lawyer Kwon. She also said that documents demanding litigation costs from the defendant's side had already been sent.
Lee said, "Someone checking on the progress told me that the documents (such as the litigation cost claim) had already been sent and the dates were all set," and when she asked lawyer Kwon's side how they would handle this, they said, "When they come, tell them to call him (the lawyer)."
A suffered bullying and took her own life in 2015. In response, Lee filed a damages claim lawsuit against the education office, the school, and the perpetrators in August of the following year, with lawyer Kwon representing the case.
The first trial court recognized the liability of one perpetrator student for damages and ruled partially in favor of the plaintiff. Lee appealed immediately to hold others accountable who were not recognized as liable.
However, lawyer Kwon did not appear at three hearings held on September 22, October 13, and November 10 of last year. As a result, the first trial's partial win was overturned to a loss, and the appeal was withdrawn.
