[Breaking] Supreme Court: "Go Young-joo's statement 'Candidate Moon Jae-in is a communist' is not defamation"
Second Instance Overturns and Remands, Recognizing 10 Million Won Liability Compensation
[Asia Economy Choi Seok-jin, Legal Affairs Specialist Reporter] The Supreme Court has ruled against civil liability for former Broadcasting Culture Promotion Agency director Go Young-ju, who called former President Moon Jae-in a 'communist' at a meeting held on January 4, 2013, at the Korea Press Center International Conference Hall, immediately after the 18th presidential election.
The Supreme Court's First Division (Presiding Justice Oh Kyung-mi) on the 16th overturned the lower court's ruling that recognized Go's liability for damages of 10 million won in the appeal trial of the damages lawsuit filed by former President Moon against former Director Go, and remanded the case to the Seoul High Court.

The court held that the problematic statement should be seen as former Director Go expressing his opinion or stance on former President Moon's ideology or beliefs based on his experience, and it was difficult to regard it as a specific factual assertion that would damage former President Moon's reputation.
