Fourth Injunction Against Party Leadership Already Filed
[Asia Economy Reporter Yoo Byung-don] Former leader of the People Power Party, Lee Jun-seok, filed an injunction with the court immediately after the appointment of Jeong Jin-seok as Emergency Response Committee Chairman, requesting the suspension of Jeong's execution of duties.
On the 8th, Lee's legal representatives issued a statement announcing that they had submitted an injunction petition to the Seoul Southern District Court, requesting the suspension of Jeong's execution of duties and the effectiveness of the resolution by the National Committee that appointed Jeong as Emergency Response Committee Chairman. This is Lee's fourth injunction application against the People Power Party and its leadership.
It is reported that Lee's side submitted related documents through the court's electronic litigation site after the agenda for Jeong's appointment was approved at the People Power Party National Committee meeting.
The legal team stated, "The resignation of Joo Ho-young and all existing emergency committee members is merely a trick to avoid violating the Constitution's prohibition on retroactive application," and argued, "Since the prior injunction ruling declared the appointment of Joo Ho-young as Emergency Committee Chairman and the establishment of the Emergency Committee itself invalid, the establishment of a 'new' Emergency Committee and the appointment of a new Emergency Committee Chairman based on that invalidity are naturally invalid."
The legal team explained that the second injunction application, which requested the suspension of duties of all eight emergency committee members, will be withdrawn as the resignation of the members has rendered the case moot.
However, they plan to maintain the lawsuit regarding the third injunction application, which seeks to suspend the effectiveness of the National Committee's party constitution amendment that specifies the requirements for establishing the Emergency Committee, in order to confirm that the amended party constitution is unconstitutional and invalid.

This injunction case filed by former leader Lee will be assigned to Civil Division 51 of the Seoul Southern District Court (Chief Presiding Judge Hwang Jeong-su), as with previous cases. This division is the only collegiate panel handling injunction cases at the Seoul Southern District Court and had partially accepted Lee's first injunction application on the 26th of last month, suspending the duties of then Emergency Committee Chairman Joo Ho-young.
