[Asia Economy Reporter Park Hyesook] A male student who attempted to sexually assault a female peer on the Inha University campus and fell from a building, resulting in her death, has been charged with murder.
The Incheon District Prosecutors' Office Women and Children Crime Investigation Division (Chief Prosecutor Gumiok) announced on the 9th that it changed the charge against A (20), a first-year student at Inha University, who was sent by the police on charges of quasi-rape resulting in death, to murder under the Special Act on the Punishment of Sexual Violence Crimes, and has indicted him in custody.
The prosecution stated that A, intoxicated and attempting to sexually assault the unconscious victim, caused her to fall from the corridor between the 2nd and 3rd floors of the building, and knowing that the victim could die, neglected her and fled. Therefore, they applied the charge of murder with indirect intent. Murder with indirect intent is recognized when the possibility of death is anticipated and there is an awareness that death cannot be helped.
A prosecution official said, "The crime scene was 8 meters above ground level, with the window sill directly connected to the outer wall, and the (1st floor) floor was asphalt, making it a structure where falling could result in death."
He added, "A, who was completely unconscious due to heavy intoxication and had no ability to protect himself, attempted to sexually assault the victim and caused her to fall to her death. Based on the facts clarified through supplementary investigation and legal review, indirect intent to murder is recognized."
Earlier, the police conducted various scenario experiments at the crime scene to confirm whether A intentionally pushed the victim and reviewed the legal aspects but judged it difficult to apply the murder charge, sending A to the prosecution on charges of causing death.
A also denied intent to murder during police investigation, acknowledging that B died after falling from the building but denying that he pushed her.
Meanwhile, the prosecution decided not to indict A on charges of filming and distributing using a camera under the Special Act on the Punishment of Sexual Violence Crimes, which was applied during the police investigation stage. This was due to the lack of clear evidence that the victim's body was filmed.
A is accused of attempting to sexually assault B, a first-year female student at the university, in a five-story college building on the Inha University campus in Michuhol-gu, Incheon, in the early hours of the 15th of last month, causing her to fall and die.
After B fell to the 1st floor of the building, A discarded B's clothes in another location and fled to his rented room, and was arrested by the police that afternoon.

B was left bleeding alone on the roadside in front of the building for about an hour and a half after the fall, was found by a passerby and taken to the hospital, but died three hours later.
