"'Tuberculosis' Hidden While Working in Cafeteria... Suspended Prison Sentence for Successor Wrongfully Dismissed"
[Asia Economy Reporter Kim Daehyun] A man in his 40s who was falsely accused of hiding the fact that he was a tuberculosis carrier while working in the company cafeteria after being fired from a group meal service company received a suspended prison sentence in the first trial.
According to the court on the 23rd, Judge Park Hyerim of the Seoul Central District Court Criminal Division 13 recently sentenced A (45, male), who was charged with false accusation, to six months in prison with a one-year suspension.
Earlier, A was prosecuted on July 13, 2020, on charges of false accusation with the intent to have B, his successor who took over his position after he was fired from a meal service company in Gangnam-gu, Seoul, criminally punished.
At that time, A submitted a complaint to the Seoul Central District Prosecutors' Office civil affairs office demanding punishment, stating that "B concealed the fact that he was a legally recognized tuberculosis carrier, joined the company, and freely accessed the cafeterias of various clients without any restrictions, thereby threatening the safety and lives of customers."
A joined the company in July 2019 but was placed on standby about two months later due to violation of work instructions and poor work attitude, and was dismissed in January of the following year. It was also revealed that he was sentenced to one year in prison for false accusation and other charges at the same court in December last year.
The first trial found A guilty. Judge Park stated, "False accusation obstructs the proper exercise of the state's judicial authority and causes waste of criminal justice functions, as well as posing a risk of unfair punishment to the falsely accused, so severe punishment is necessary."
However, he added, "Considering that he belatedly admitted his wrongdoing and that B was not prosecuted for the falsely accused crime."
