Police Specify Exceptional Investigation Command Scope of Commissioner General in Investigation Rules
[Asia Economy Reporter Seongpil Cho] The police have clarified the scope within which the Commissioner General of the National Police Agency can give specific investigative instructions on individual cases under the Criminal Investigation Regulations.
According to the police on the 18th, the National Police Commission passed a partial amendment to the Criminal Investigation Regulations (directive) at its regular meeting that day. Besides clarifying the scope of investigative instructions by the Commissioner General, the amendment introduced a provision allowing the Commissioner General to receive reports related to case investigations "when necessary" to determine whether a case falls under their investigative command. The amendment also established retention periods and criteria for different types of cases, providing grounds to set separate retention periods, such as quasi-permanent retention for important cases. Additionally, it stipulated measures to be taken upon the expiration of case record retention periods.

At the same meeting, a partial amendment to the Act on the Safety Control of Firearms, Swords, Explosives, etc. was also passed. The amendment strengthens safety management of firearms, swords, explosives, spray devices, electronic shock devices, and crossbows, and aims to ensure the effectiveness of the licensing system. Notably, "stalking crimes" were added as disqualifying reasons for firearm possession permits. Furthermore, the amendment enhances the expertise of the Firearms and Explosives Safety Technology Association and, considering the term status of organizations under other ministries, extended the term of the association's chairman from two years to three years.
