Former Vice President Kang Kyung-hoon Sentenced to 1 Year and 4 Months in Prison for 'Everland Union Busting' Case
Obstruction of Union Activities Including Establishment of 'Eoyong Nojo'...1st and 2nd Trials: "Group-Level Organization and Continuous Crime"
[Asia Economy Reporter Heo Kyung-jun] Kang Kyung-hoon, former Vice President of Samsung Electronics (58), who was prosecuted for the Samsung Everland union dissolution case, has been sentenced to imprisonment.
The Supreme Court's 2nd Division (Presiding Justice Lee Dong-won) on the 17th upheld the original sentence of 1 year and 4 months imprisonment for Kang, who was charged with obstruction of business and other offenses.
The court also upheld the original rulings against former and current Everland executives and employees who were prosecuted together. Former Everland Executive Director Lee received a 10-month prison sentence, and about 10 former and current Everland employees were sentenced to 6 to 10 months imprisonment with 2 years probation and fines.
The court stated, "It confirmed the appropriateness of the original ruling that recognized unfair disciplinary actions against genuine union members as obstruction of business related to the genuine union, and acknowledged the violation of the Trade Union Act against employer-side executives who controlled and intervened in the establishment and operation of the company union, as well as the union chairpersons who conspired with them."
Kang and others were charged with obstructing union activities at Everland by establishing so-called 'company unions' while working at Samsung Group's Future Strategy Office from June 2011 to March 2018.
The first and second trials judged that "to neutralize the Samsung union, the Future Strategy Office and Everland personnel mobilized a meticulous plan and executed it, causing significant damage to the union," and determined that the Everland union dissolution case was an 'organized and continuous crime' carried out at the group level.

Meanwhile, Kang was also convicted by the Supreme Court last year for establishing a union dissolution strategy known as the 'Greenification operation' at Samsung Electronics Service, a subsidiary of Samsung Electronics, after a union was formed there in 2013, which was implemented at the group level.
