Jeonnam Yeonggwang-gun Loses Administrative Lawsuit Against 'SRF Ban'... Power Plant Construction Gains Momentum
[Asia Economy Honam Reporting Headquarters Reporter Park Jin-hyung] Yeonggwang-gun, Jeollanam-do lost an administrative lawsuit related to the SRF combined heat and power generation.
The Gwangju District Court Criminal Division 1 (Presiding Judge Park Hyun) ruled in favor of the plaintiff on the 10th in the lawsuit filed by Yeonggwang Combined Heat and Power against the mayor of Yeonggwang-gun to cancel the decision to deny the use permit for solid fuel (SRF) products.
Yeonggwang Combined Heat and Power obtained a 9.9㎿ power generation permit from the Ministry of Trade, Industry and Energy on November 29, 2017, and subsequently acquired building permits, waste comprehensive recycling business suitability notifications, and building (modification) permits from Yeonggwang-gun.
Following this, the project proceeded smoothly with approval of the construction plan from Jeollanam-do, issuance of the integrated environmental preliminary consultation document from the Ministry of Environment, and so on.
However, opposition from some residents against the construction began to spread. In response, Yeonggwang-gun issued a decision to deny the use permit for solid fuel products on July 31, 2020, citing five reasons including expected environmental pollution due to waste import and emission of environmentally harmful substances.
The power plant side filed an administrative lawsuit in March 2021, arguing that as long as the usage permit requirements stipulated in the Resource Recycling Act are met, the permit should be granted in principle.

Following this ruling, the construction of the power plant is expected to return to a normal trajectory.
