Jeon Du-hwan 'Memoir Civil Trial' Final Arguments in March Next Year
[Asia Economy Honam Reporting Headquarters Reporter Park Jin-hyung] The final arguments of the parties in the civil lawsuit over the memoirs of the late Jeon Du-hwan have been postponed to next year.
The Civil Division 2-2 of the Gwangju High Court (Presiding Judges Kang Moon-kyung, Kim Seung-joo, Lee Soo-young) held an appellate hearing on the 22nd for a damages claim lawsuit filed by four organizations and the bereaved family of the late Father Jo Bi-o, represented by Father Jo Young-dae, against Jeon and his son Jeon Jae-guk.
The court stated to the defendants, "After organizing the lawsuit succession procedures, we will set a date for the final arguments," and scheduled the trial for March 20 of next year.
It added, "Whether Jeon's children will file for limited approval of inheritance and other related matters must be settled for the parties to the lawsuit to be confirmed. Otherwise, the trial concerning Jeon cannot be concluded."
The defendants explained that the inheritance issue has not yet been resolved and that they will proceed with the succession procedures after consulting with the bereaved family.
According to Article 233 of the Civil Procedure Act, the heirs of the deceased Jeon will undertake the lawsuit succession procedures and can participate in the trial on behalf of Jeon.
Although the lawsuit against Jeon has not yet been finalized, the lawsuit against his son will continue as is.
Due to the court’s regular personnel reshuffle in February next year, a different panel will preside over the next trial.
Previously, the first trial court ruled partially in favor of the plaintiffs, finding 23 claims described in the memoirs?such as North Korean military involvement, helicopter gunfire, use of firearms by martial law troops, and the assault on Gwangju Prison?to be false statements without objective evidence.
