Teenage Male Given Suspended Sentence for Sexually Assaulting Intoxicated Female Student
[Asia Economy Honam Reporting Headquarters Reporter Park Jin-hyung] Two high school students, including one who sexually assaulted a teenage female student, were sentenced to probation.
The 11th Criminal Division of the Gwangju District Court (Presiding Judge Jeong Ji-seon) on the 26th sentenced A (19), who was indicted on charges of quasi-rape, to 2 years and 6 months in prison with 3 years of probation.
B, who was tried on charges of similar sexual acts through deception, was sentenced to 1 year and 6 months in prison with 2 years of probation.
They were also ordered to complete a 40-hour sexual violence treatment program and were restricted from employment at institutions related to children, adolescents, and persons with disabilities for 3 years.
A was charged with forcibly having sexual intercourse when one of the two female students, with whom A and B had been drinking, was in a state of intoxication and unable to resist. B is accused of using force against another female student to engage in similar sexual acts.
One of the women reportedly left a message saying "I'm sorry, thank you" to an acquaintance after being sexually assaulted and made an extreme choice.
A reached a settlement with the bereaved family, and the victim's side reportedly conveyed to the court that they did not wish for punishment.
Regarding this case, at the time the crime occurred, the deceased female victim called an acquaintance, and eight men came to the house and assaulted A.
The court said, "Considering the age of the victim, who is a child and adolescent, it appears that she suffered considerable mental shock, and in the subsequent incident, the quasi-rape victim committed suicide."
It added, "Although there is no direct causal relationship between A's crime and the suicide, it resulted in adding weight to this case."
However, the court explained the sentencing reason by stating, "The defendants admitted to the crime, showed remorse, and have no prior criminal record."
