60s Man Who Detained Elementary Student on Street and Committed Perverted Acts... Sentence Increased in Appeal Trial
[Asia Economy Yeongnam Reporting Headquarters, Reporter Kim Yong-woo] A man in his 60s who forcibly took a male elementary school student he met on the street and confined him while committing perverted sexual crimes had his sentence increased in the appellate court.
The Busan High Court Criminal Division 1 (Presiding Judge Park Jong-hoon) announced on the 2nd that it overturned the original sentence of 12 years imprisonment and sentenced A, who was tried for violating the Special Act on the Punishment of Sexual Violence Crimes, to 15 years imprisonment in the appellate trial.
Additionally, A was ordered to be banned from employment at child and youth-related institutions and welfare facilities for the disabled for 10 years, to have his personal information disclosed and notified, and to wear an electronic tracking device for 30 years.
According to the Busan High Court, A is accused of threatening a male elementary school student walking on the street, taking him to his residence, and confining him for 8 hours.
It was revealed that A committed various perverted obscene acts after detaining the elementary school student.
A was diagnosed as belonging to the 'probable alcohol use disorder group' in the alcohol use disorder screening test and was also assessed as having a high risk of sexual crime recidivism according to the Korean Sexual Offender Risk Assessment Scale.
The first trial court sentenced A to 12 years imprisonment.
A appealed, claiming he was intoxicated and in a state of diminished mental capacity at the time of the crime, and the prosecution also appealed, arguing the sentence was too light.
The second trial court stated, "Although it is acknowledged that the defendant was intoxicated, considering the circumstances and details of the crime and that he remembered and specifically testified about much of what he said, it does not appear that he was in a state of diminished mental capacity."
It also stated, "The defendant has a prior record of being punished for forcibly molesting males three times besides this case," and "About 20 years ago, similarly, he was sentenced to 2 years imprisonment for luring a minor to his residence and forcibly molesting him."

The court explained the sentencing reasoning, saying, "The defendant caused mental suffering to a young boy for his twisted sexual desires. There is concern that the victim will carry an unhealable wound for life," and "The victim's parents are also pleading for severe punishment."
