"Father Furious Over No Charges for Perpetrators in Sexual Assault of Daughter with Intellectual Disability and Three High School Students"
[Asia Economy Reporter Kang Juhee] A father’s story has come to light, expressing his frustration that his middle school daughter with borderline intellectual disability was sexually assaulted by three high school students, yet the perpetrators were cleared of charges.
On the 10th, a petition titled "My daughter was sexually assaulted three times within a week by three high school students shortly after graduating from elementary school" was posted on the Blue House National Petition Board.
A, who identified himself as the head of a multicultural family with a daughter in the second year of middle school, opened up, saying, "In April 2020, when my daughter had just entered middle school, I received the devastating news that she had been sexually assaulted three times over the course of a week by three high school students."
He continued, "It was such a shocking incident that I filed a complaint against the perpetrators, believing they would receive appropriate punishment." However, according to A, the police concluded the case with no charges, citing reasons such as the victim’s testimony being neither specific nor consistent.

View original imageHe stated, "The police judged that my daughter’s testimony was neither specific nor consistent, and since she met the perpetrators even after the sexual encounters, and after reviewing related CCTV footage, it was difficult to view her as a rape victim." He added, "However, my daughter has borderline intellectual disability (IQ around 74). Her language comprehension and working memory scores are very low, so her short-term memory is insufficient, making it impossible for her to provide consistent or specific testimony."
He also said, "It is completely unreasonable to think that my 12-year-old daughter would consensually have sexual relations with three high school students over a week. The fact that she met the perpetrators after the assault simply accepts their claims as they are," and added, "While it is true that my daughter met the perpetrators, it was only because her friend invited her out, and the perpetrators happened to be there."
A expressed anger that no polygraph test was conducted on the perpetrators during the police investigation. He said, "The perpetrators refused, saying they would only agree if my daughter took a polygraph test," and pointed out, "If they were innocent and had nothing to hide, shouldn’t they have agreed to the polygraph test?"
A also revealed that while the perpetrators attend school regularly, his daughter has been unable to attend school properly due to rumors, resulting in her repeating a grade and receiving counseling treatment due to the trauma. He appealed, "I hope the investigative authorities conduct a fair investigation without any shame toward my young daughter," and pleaded, "I, powerless as I am, want to protect my daughter and help her have hope."

Meanwhile, the Gyeonggi Northern Provincial Police Agency, which handled the related investigation, forwarded the perpetrators to the prosecution on charges of violating the Child Welfare Act. The police reportedly applied the Child Welfare Act violation charges instead of sexual assault charges, considering that the victim had not received an official intellectual disability diagnosis through a medical institution and that the perpetrators stated there was no violence or threats. The police also stated that they are conducting additional investigations in response to the prosecution’s request for supplementary investigation.
