[Asia Economy Reporter Kim Seohyun] The appeal of a woman in her 20s, who was sentenced to prison in the first trial for throwing her newborn baby from the fourth floor to death, has been dismissed.
The Criminal Division 4-3 of Uijeongbu District Court (Chief Judges Lee Younghwan, Kim Yongdu, and Lee Euijin) announced on the 22nd that it dismissed the appeal of defendant A, who was charged with infanticide, on the 22nd.
Previously, the first trial sentenced A to two years in prison and ordered a five-year employment ban at child and youth-related institutions. The first trial court stated the reason for sentencing, saying, "The defendant committed a crime that infringed on the most important right to life for humans," and "considered the fact that the defendant admitted to the crime and showed remorse."
A appealed, claiming "the sentence in the first trial is too heavy." The prosecution also appealed, arguing the sentence was too light, but the court rejected both appeals, stating, "No new sentencing materials have emerged, and the original sentence does not appear to be too light or too heavy."
Furthermore, the court added, "The defendant claims to have committed the crime in a confused state, but at the defendant's age, she should have been able to judge the situation well and respond wisely."
A is accused of throwing her newborn baby out of the window from the fourth floor of a villa in Ilsanseo-gu, Goyang-si, Gyeonggi Province, around 6 a.m. on January 16.
On the same day in the afternoon, a resident found the deceased baby hidden between buildings and reported it to the police. At that time, the baby was naked and still had the umbilical cord attached. The National Forensic Service, which performed an autopsy on the baby's body, concluded that the cause of death was skull fracture and multiple injuries throughout the body.
