Incheon Airport Corporation Wins Possession Lawsuit Against Sky72 Golf Course (Update)

View original image[Asia Economy Reporter Park Hyesook] In the lawsuit between Incheon International Airport Corporation and the golf course operator surrounding Sky72 Golf Course on Yeongjongdo Island, Incheon, the airport corporation won the case.
The Administrative Division 1-1 of the Incheon District Court (Presiding Judge Yang Jijeong) ruled on the 22nd in favor of the plaintiff, Incheon Airport Corporation, in the 'eviction lawsuit' seeking the transfer (registration) of ownership of buildings and facilities such as the golf course clubhouse against Sky72 Golf & Resort (Sky72).
The court also dismissed Sky72's 'confirmation of negotiation obligation lawsuit' related to contract renewal filed against the airport corporation.
The court stated, "The land use period for (Sky72) appears to have ended on December 31, 2020," and "Considering that the defendant (Sky72) participated in the business after calculating investment returns, the contents of the implementation agreement with the corporation cannot be seen as unfavorable to the defendant."
It further stated, "The claim for reimbursement of beneficial expenses (costs spent by the lessee to enhance the value of the real estate) by (Sky72) seems to have already been exercised or waived," and "Requests for on-site inspection, appraisal, and trial submissions are all denied."
Following the first trial victory, Incheon Airport Corporation plans to proceed with the provisional execution procedure immediately.
Sky72, which has operated the golf course by leasing land from Incheon Airport Corporation since July 2002, had its lease contract expire on December 31 last year but continued operations while claiming ownership of golf course facilities and beneficial expenses, leading to legal disputes with the corporation.
The airport corporation filed a lawsuit claiming that Sky72 is unlawfully occupying the golf course land and demanding the return of the land and transfer of ownership.

In response, Sky72 filed a lawsuit against the airport corporation, asserting that the corporation had an obligation to negotiate for contract extension but failed to do so.
