'Called a Game Part-timer'... 20s Fined for Small Payments After Mobile Phone Activation
[Asia Economy Reporter Seongpil Cho] A man in his 20s who deceived an acquaintance into opening a mobile phone line under the pretense of using it for game promotion and made online payments worth several million won was sentenced to a fine.
On the 13th, according to the legal community, Judge Donghee Lee of the Criminal Division 2 at the Seoul Central District Court sentenced A (23) to a fine of 1.5 million won on charges of fraud. The court pointed out, "There is a strong need to punish the method itself, as the defendant deceived the victim into opening a mobile phone line and caused damage. The amount of damage is also considerable." However, it added, "Considering the defendant reimbursed the damage amount and the victim does not wish for the defendant to be punished, among other sentencing factors."
A was indicted for conspiring with accomplice B to receive three newly opened latest-model iPhones from acquaintance C in the Gangnam-gu area of Seoul in August 2019 and making small payments worth about 2.2 million won for game items. A was investigated to have deceived by saying, "If you open a mobile phone line to be used for game promotion, we will pay 150,000 won per phone as a part-time job," and "After using it for six months, we will cancel it and cover the communication fees and other costs." The total damage, including the iPhone device costs, amounted to 8 million won.

However, A appealed the court's decision, claiming, "I was also a victim deceived by B and had no intent to commit fraud," and requested a formal trial. The court did not accept A's claims in the formal trial. The court stated, "The defendant directly explained the part-time job details to the victim and conveyed B's instructions," and "It is possible to recognize a conspiracy relationship with B and to see that there was intent to commit fraud."
