Court Sentences Defendants to Prison Consecutively for Retaliatory Crimes Reported to Police
[Asia Economy Reporter Choi Seok-jin] Defendants who retaliated by assaulting or threatening victims who reported them to the police have been consecutively sentenced to prison by the court.
On the 12th, the Criminal Division 13 of the Uijeongbu District Court announced that defendant A, charged with forcible molestation and retaliatory threats under the Act on the Aggravated Punishment of Specific Crimes, was sentenced to three years in prison. The court also ordered A to complete a 40-hour sexual violence treatment program and imposed a seven-year employment restriction at youth-related institutions and facilities for the disabled.
The court stated, "The defendant has been harassing the victim since 2016, and considering the frequency and methods of the crimes, the nature of the offense is serious. The defendant has a prior record of similar crimes and committed the offenses during the probation period, making severe punishment inevitable."
According to the court, A entered B’s store twice on August 12 and 29 last year, causing a disturbance while intoxicated. When B asked him to leave, A threw an ashtray from the smoking area, breaking the store’s door, and also committed forcible molestation.
A reappeared a few days later, causing a commotion by throwing a cellphone, and when B reported him to the police, A threatened B with retaliation while cursing and throwing a glass on the floor.
At trial, A claimed, "I was angry and used harsh language while drunk, but I had no real intention to retaliate," but this was not accepted.
Another defendant, C, involved in retaliatory crimes, was also sentenced to one year in prison by the court.
C is accused of threatening D by sending text messages and making phone calls saying "I will kill you" after D, whom C assaulted during a drunken argument on June 19 last year, reported C to the police and requested his appearance.
