[Asia Economy Reporter Kim Bong-ju] A man in his 50s who operated a restaurant after retiring from 20 years of service as a police officer was sentenced to prison for raping a foreign part-time worker. An attempt to destroy evidence during the crime was also detected.
On the 4th, the Criminal Division 4 of Changwon District Court sentenced A (54) to four years in prison on charges including rape causing injury. He was also ordered to complete 40 hours of sexual violence treatment programs and was banned from employment at child, youth, and disabled welfare facilities for seven years. However, the court dismissed the prosecution's request to attach a location tracking device.
A was arrested and indicted on charges of sexually assaulting B, a Vietnamese woman in her 20s who had just started working part-time at a restaurant in Seongsan-gu, Changwon-si, Gyeongnam, at 11:23 p.m. on August 17 last year.
The crime was reported to the police when B, an international student at a certain university, contacted acquaintances at her school dormitory.
A admitted to having sexual intercourse but claimed it was "consensual." He argued that "the victim's statements were inconsistent, and there was no violence or threats to suppress resistance."
However, the court did not accept A's claims. The court stated, "The victim's statements were consistent and without contradictions, and no irrational parts were found."
The court rebutted A's claim of consensual sex, citing that although evidence was not properly preserved, the defendant's DNA was detected on the victim's upper and lower clothes, both fingernails, and body. It also noted the 34-year age difference between the two and that they met for the first time on the day of the incident as a boss and part-time worker.
In particular, the court judged that A's action of washing B's clothes stained with blood and vomit was an attempt to destroy evidence.
Removing not only B's clothes but also her underwear and leaving her naked to wash the vomit goes against common sense, and it was pointed out that A, who had worked as a police officer for 20 years, tried to eliminate evidence.
Based on these circumstances, the court stated, "(It is) difficult to see that the victim meticulously planned the approach for monetary compensation and fabricated evidence."

The court ruled, "The young victim who entered Korea dreaming of a bright future will likely take a long time to recover from the shock and pain caused by the crime and return to her daily life," adding, "Considering that A was on probation for a previous sexual assault charge and has not been forgiven by the victim."
