Yeonggwang-gun Allows 'Outdoor Dining for Restaurants' Starting This Year
[Yeonggwang=Asia Economy Honam Reporting Headquarters reporter Lee Jeonseong] Yeonggwang-gun, Jeollanam-do (Governor Kim Junsung) announced on the 6th that the Enforcement Rules of the Food Sanitation Act have been revised and promulgated, allowing outdoor operations of food service establishments starting this year.
The scope of outdoor operations applies only when the indoor and outdoor business areas of rest food service establishments, general restaurants, and bakeries are directly adjacent. When outdoor operations are permitted, ensuring food safety must be the top priority, and there must be no violations of other laws.
Since outdoor operations must comply with possible locations, restrictions, and safety facility standards, the necessary documents for the reporting procedure must be submitted to the Permit Team at the Comprehensive Civil Service Office. After the responsible official reviews the documents and inspects the facilities, the business must complete the report for changes in business area according to the possibility of outdoor operations before operating.
Violations will result in administrative actions such as correction orders and business suspension, so reporting changes in the business area is mandatory.
The required documents include a checklist for prior confirmation of outdoor operation feasibility completed by the business operator, proof of legitimate usage rights for the external location such as building status maps including layout and floor plans, a copy of the certificate of registered matters, usage contracts, documents confirming exclusive use of outdoor areas in multi-tenant buildings, occupancy permits, and facility photos if necessary. The business operator must directly measure the area of the intended business site and indicate and record it on the building status map.
Outdoor operators are prohibited from placing trash bins in the outdoor business area to maintain cleanliness, must move all customer service facilities indoors after business hours, and must install signs indicating non-smoking zones.
If the reported business area after changes is 100㎡ or larger, the operator must subscribe to disaster liability insurance, among other compliance requirements that must be understood.
