Jeonnam Police Agency Gyeonguhoe Urges Amendment of Legislative Notice to Complete Prosecution Reform
Announcement on the Position Regarding the Legislative Notice of the Enforcement Decrees of the Criminal Procedure Act and the Prosecutor's Office Act Related to Investigation Structure Reform
[Asia Economy Honam Reporting Headquarters Reporter Kim Chunsu] As the legislative notice procedure for the Enforcement Decrees of the Criminal Procedure Act and the Prosecutors' Office Act for investigative structure reform has concluded, the Jeonnam Police Agency Association is strongly opposing it.
The Association evaluates that the current legislative notice draft fails to uphold the original intentions of "checks and balances" and "prosecutorial reform" at all.
On the 18th, the Jeonnam Police Agency Association issued a statement at the Jeonnam Provincial Police Agency urging revisions to the legislative notice draft related to investigative authority adjustment.
The Association pointed out issues such as ▲the presidential decree being designated to be solely overseen by the Ministry of Justice, to which the prosecution belongs ▲the creation of multiple control mechanisms exceeding the scope delegated by law, thereby weakening the police's authority to conclude investigations ▲the possibility of unlimited expansion of the prosecutor's direct investigation scope simply by obtaining a search and seizure warrant.
The Association stated, “As police officers who have devoted themselves to protecting the safety of the people and as citizens who hope for an advanced criminal justice system, we strongly urge the revision of the legislative notice draft.”
So far, various voices calling for revisions to the legislative notice draft have emerged not only from within the police but also from the Police Commission, the Korean Bar Association, People’s Solidarity for Participatory Democracy, academia, and public servants’ unions; however, there was no public discussion process.

The period for the legislative notice of the presidential decree containing the detailed contents of the investigative structure reform ended on the 16th, and only the procedures remain for review by the Ministry of Government Legislation, deliberation by the Vice Ministerial Meeting and the Cabinet Meeting, followed by the President’s approval, after which it will be published in the official gazette and promulgated.
