Notice of Legislative Proposal for Amendment to the Enforcement Rules of the Regulations on Relief for Adverse Drug Reactions
[Asia Economy Reporter Seo So-jeong] The objection procedure for pharmaceutical side effect damage relief will be simplified.
The Ministry of Food and Drug Safety (Commissioner Lee Ui-kyung) announced on the 16th that it will give prior notice of the amendment to the "Enforcement Rules of the Regulations on Pharmaceutical Side Effect Damage Relief" to strengthen the rights of applicants for pharmaceutical side effect damage relief.
The pharmaceutical side effect damage relief system is a system that provides damage relief benefits such as death lump-sum compensation, disability lump-sum compensation, funeral expenses, and medical expenses to patients and bereaved families when damage such as death, disability, or illness occurs unexpectedly despite normal use of pharmaceuticals.
The proposed amendment includes improvements allowing applicants who have objections to the results of their pharmaceutical side effect damage relief application to directly file an objection with the Director of the Korea Institute of Drug Safety & Risk Management.
Until now, applicants dissatisfied with the review results could only raise objections through administrative appeals, but with the amendment of the enforcement rules, they will be able to exercise their rights more conveniently.

The Ministry of Food and Drug Safety stated, "We expect that this amendment will expand compensation for damages caused by pharmaceutical side effects," and added, "We will continue to improve the pharmaceutical side effect damage relief system so that it can serve as a social safety net benefiting many citizens."
