SK Innovation "LG Chem, Stop Baseless Claims and Engage in Litigation"
[Asia Economy Reporter Park So-yeon] On the 4th, SK Innovation urged LG Chem, which is currently engaged in a 'battery lawsuit,' to "stop making groundless claims and participate in the lawsuit fairly."
In a statement released that day, SK Innovation said, "LG Chem claims that SK Innovation's patent (994) is invalid because there is a product that precedes the patent developed by SK Innovation. However, we clearly state that this patent is a technology independently developed by SK Innovation."
Earlier that day, LG Chem claimed that SK Innovation not only stole battery technology and registered patents but also filed a lawsuit against LG Chem.
In response, SK said, "LG Chem monitors competitors' patent developments and has filed numerous objections to block patent registrations," adding, "If LG Chem believed its technology could be patented, it would have raised objections at the time of application." Furthermore, SK stated, "If LG's prior technology had existed at the time of SK's patent application, the patent would not have been registered."
SK asserted, "At the time the patent lawsuit was filed, LG Chem was not even aware of the 'product claimed as prior art' and only submitted it belatedly after the lawsuit had progressed significantly, insisting on similarities."
SK added, "This process is known to all lawyers and parties involved in the lawsuit, but we cannot help but be disappointed with LG Chem, which goes beyond legal arguments to exaggerate and distort SK Innovation's independent patent as if it were their own well-known technology."
SK expressed concern, saying, "We worry that LG Chem might misunderstand that difficulties in proving their case in the lawsuit can be resolved through such external controversies," and clarified, "No materials related to this patent lawsuit have been deleted concerning the evidence destruction claims made by LG Chem." The company emphasized, "This will be clarified at the ITC. As the party that filed this lawsuit, we have no reason to delete any materials, nor have we done so."
Furthermore, SK stated, "LG Chem is searching for document deletions and using this as a claim, which may appear undesirable as it seems they are not interested in verifying and clarifying facts due to the lack of objective evidence."
SK Innovation said, "Within the lawsuit, we will seriously respond to any distortions and exaggerated claims by LG Chem," and reiterated, "Actions that mislead public opinion outside the lawsuit by presenting distorted claims as proven facts must no longer continue." They added, "Although we are parties in dispute, we hope that the truth will be uncovered according to the rules set in the litigation process with mutual respect."
