The reason given was to restore trust in the process of resolving conflicts over medical policy together with the ruling party and the medical community. However, since the current allegations clearly violate the law and the government had declared it would proceed with direct prosecution and strict investigation, this stance puts the government in a position of contradicting itself.
Kim Heon-ju, Director of Health and Medical Policy at the Ministry of Health and Welfare, said at a briefing on the 4th, "Regarding the prosecution measures, we will comprehensively consider the consultations between the party and the Korean Medical Association (KMA) in the morning, as well as the statements of the party leader and KMA President Choi Dae-jip," adding, "We will take the most reasonable possible measures in order to promptly normalize medical treatment and restore mutual trust."
Earlier that morning, the Korean Medical Association and the Democratic Party signed a policy agreement implementation memorandum. Lee Nak-yeon, leader of the Democratic Party, said regarding the prosecution of residents, "We will strive to resolve this in the best possible way." President Choi also stated, "We will request the government for the best handling plan and ensure that no one gets hurt."

View original imageEarlier, when the residents' group began collective actions such as a group strike, the government issued a work commencement order on the 26th of last month to residents and fellows at training hospitals in the metropolitan area. This was a measure under the Medical Service Act. After on-site investigations, the government reported 10 residents who did not return to the emergency room in violation of the order. Among them, charges against four were withdrawn after it was confirmed that they were either dispatched or had worked.
The government initially issued the work commencement order and took prosecution measures because the shortage of doctors at frontline medical sites caused disruptions in treatment and surgeries, resulting in patient harm. Since the legal violation was clear, the police also declared that they would start investigations as soon as the complaint was filed and strictly enforce judicial measures.
The previously tense standoff between the medical community and the government over medical policy, which was the root cause of the conflict, has changed as they agreed to hold future consultations. However, the fact that the prosecuted residents did not comply with the work commencement order at the time remains unchanged. Determining the violation and any resulting punishment depends on future police investigations and court rulings. If the government withdraws charges against the remaining six, the earlier prosecution could be perceived as an emotional reaction. The "strict application of the law" emphasized at the time of prosecution would also become an empty statement.
