30s Man Attempts Sexual Assault on Drunken Junior Colleague... Suspended Sentence Given
[Asia Economy Yeongnam Reporting Headquarters Reporter Kang Sharon] On the 17th, the Criminal Division 4 of Changwon District Court announced that A (36), who was tried on charges of attempting to sexually assault a junior colleague (residential intrusion and quasi-rape), was sentenced to 2 years and 6 months in prison with a 4-year probation.
In October 2017, A took a female victim in her 20s, a junior colleague, to her residence in Gimhae, Gyeongnam, after having a company dinner with coworkers.
He then followed her into the house and attempted to sexually assault her by taking advantage of her inability to resist, but the attempt failed as the victim regained consciousness and resisted by shouting.
The court decided not to disclose or notify A’s personal information, considering that he had no prior record of similar crimes and it was difficult to conclude that there was a risk of reoffending, and that the preventive effect of sexual violence crimes seemed relatively low compared to the disadvantages and expected side effects. The court also exempted him from the employment restriction order.

The court stated, "The defendant entered the residence without the victim’s consent in the early morning and attempted the crime, which is a serious offense. However, considering that the crime was only attempted and that the defendant reached an agreement with the victim, the sentence is determined accordingly."
