Hanwha Q CELLS Wins Patent Infringement Lawsuit in Germany
[Asia Economy Reporter Hwang Yoon-joo] The D?sseldorf Regional Court in Germany ruled on the 16th that the three defendants, Jinko Solar, REC, and LONGi Solar, infringed on Hanwha Q CELLS' patents in a patent infringement lawsuit filed by Hanwha Q CELLS.
Hanwha Q CELLS filed this lawsuit in March last year to promote healthy technological competition and the value of innovation in the solar industry, aiming to establish sound research competition within the sector. As a result of this ruling, the defendant companies are prohibited from importing and selling the infringing products in Germany, must destroy the infringing products, and are obligated to recall infringing products distributed since January 30 of last year.
The patented technology involved in Hanwha Q CELLS' lawsuit relates to forming a passivation layer on the rear side of solar cells, which reflects light passing through the solar cell back into the cell to increase power generation efficiency. The patent in question covers technology that reliably forms a film consisting of a first layer made of aluminum oxide and a second layer containing hydrogen on solar cells with a thickness of 180 to 200 micrometers, enabling the mass production of high-efficiency solar cells.
Jung Ji-won, Executive Vice President and Chief Technology Officer (CTO) of Hanwha Q CELLS, stated, "Technologies developed through research and development not only drive industrial innovation but are also the result of the efforts of each research entity," adding, "If Hanwha Q CELLS' world-class intellectual property rights are infringed upon, we will continue to take all necessary measures, including direct litigation, in other regions."
Meanwhile, Hanwha Q CELLS is also pursuing patent lawsuits against Jinko Solar, REC, and LONGi Solar regarding this technology in the United States and Australia, and plans to appeal the patent non-infringement decision issued by the U.S. International Trade Commission (ITC) on the 3rd.
