Development of Pyeongtaek 'Hyeondeok District' Gains Momentum... Gyeonggi-do Wins in Second Trial
[Asia Economy (Pyeongtaek) = Reporter Lee Young-gyu] The Gyeonggi-do Hwanghae Free Economic Zone Authority, which is engaged in a lawsuit with Daehanminguk Junggukseong Development Co., Ltd. over the Pyeongtaek Hyeondeok District development project, won the second trial, giving momentum to the project promotion.
Gyeonggi Province announced on the 1st that the Suwon High Court Administrative Division 1 recently ruled to dismiss the plaintiff in the 'Cancellation of Designation as Project Implementer for Hyeondeok District Development Project' lawsuit filed by Junggukseong Development against Hwanghae Free Economic Zone Authority, the same as the first trial result.
This legal battle began when the Gyeonggi Hwanghae Free Economic Zone Authority canceled Junggukseong Development's designation as the project implementer in August 2018, citing that it fell under the grounds for cancellation under the Special Act on Designation and Operation of Free Economic Zones.
The Hwanghae Authority cited reasons for cancellation including the clear inability of the project implementer to complete the Hyeondeok District development project within the implementation period, failure to secure land compensation and capital without justifiable reasons, and non-compliance with implementation orders.
In response, Junggukseong Development, the project implementer, filed a lawsuit claiming that the cancellation of the project implementer designation was illegal due to delays caused by force majeure such as intensified Korea-China conflicts over the THAAD deployment.
The Hyeondeok District development project involves developing 2,316,161㎡ in Jangsu-ri and Gwongwan-ri, Hyeondeok-myeon, Pyeongtaek-si, Gyeonggi-do. After canceling the designation of the project implementer, the province switched to a method where public institutions participate in the project.
Currently, Gyeonggi Urban Corporation has commissioned the Local Public Enterprise Evaluation Institute to review the project's feasibility.

A Hwanghae Authority official stated, "We are promoting the project with the goal of selecting an alternative project implementer by this year," adding, "With the second trial ruling, the legal dispute is temporarily settled, and we expect the long-delayed Hyeondeok District development to gain momentum."
