Supporting the On-Site Implementation of the Fully Revised Procurement Business Act After 26 Years
[Asia Economy (Daejeon) Reporter Jeong Il-woong] The full revision bill of the Act on Procurement Business was passed at the National Assembly plenary session on the 6th. This full revision is the first in 26 years since the enactment of the same law.
According to the Public Procurement Service on the 10th, the amendment focuses on reflecting changes in the public procurement policy environment, including ▲ the establishment of the Procurement Policy Deliberation Committee ▲ designation of "Procurement Day" ▲ support for procurement companies such as startups and ventures and innovative products ▲ preparation of legal grounds for invasive administrative measures.
First, through the full revision, the Public Procurement Service will establish the "Procurement Policy Deliberation Committee," a pan-governmental policy decision-making body that formulates major policies and systems in the public procurement sector, providing legal grounds for related ministries and private members to jointly establish integrated policies in the public procurement field.
Also, the government-designated "Procurement Day" will be set on September 30 to raise public awareness of public procurement services.
Support for public purchases of procurement companies such as startups and ventures and innovative products will be carried out by newly establishing legal grounds to open initial sales channels for startups, venture companies, and innovative products in the public sector, thereby contributing to the promotion of technological innovation in the private sector.
In addition, the Public Procurement Service plans to strengthen the rights and interests of contracting parties by stipulating in the law, according to the principle of legal reservation, the grounds for invasive administrative measures related to citizens' rights and obligations, such as suspension of transactions, suspension of the effect of designation as excellent procurement goods, and resale restrictions on stockpiled materials, to maintain transparency and fairness in the public procurement market.
The full revision bill with these contents will be enforced six months after promulgation. Accordingly, the Public Procurement Service plans to revise the Enforcement Decree, Enforcement Rules, and administrative rules of the Procurement Business Act in preparation for the implementation of the full revision bill.
Meanwhile, the Act on Procurement Business was enacted in 1996 to establish an institutional foundation for the efficient execution of procurement business. Partial supplements have been made so far to support small and medium-sized enterprises.

However, due to the complexity of the legal system caused by partial supplements and limitations in reflecting the changed policy environment in the process of carrying out procurement business, such as the recent 4th Industrial Revolution, the necessity for a full revision was raised.
