40s Son Who Beat 70s Mother to Death... Sentence Reduced in Appeal Trial
[Asia Economy Intern Reporter Kim Yeon-ju] A man in his 40s who assaulted his elderly mother, causing her death, received a reduced sentence in the appellate court.
The 1st Criminal Division of the Gwangju High Court (Presiding Judge Kim Tae-ho) announced on the 13th that it overturned the original verdict and sentenced A (48), who was charged with killing a family member, to 7 years in prison in the appeal trial.
Previously, in the first trial, A was sentenced to 10 years in prison.
The second trial court stated, "A’s crime resulted in the death of his elderly mother," and "the crime is very serious as the bereaved family suffered shock."
However, the court explained the sentencing reasoning, saying, "Considering that A admitted to the crime, the bereaved family requested leniency, and the crime was committed in a state of diminished mental capacity, the original sentence seems heavy."
A was charged with assaulting and causing the death of his mother B (72) at an apartment in Buk-gu, Gwangju, from 10 p.m. on July 18 last year until approximately 6:40 a.m. the next day (19th).
It was investigated that A drank alcohol, argued with his mother, and then used violence.
During the police investigation, A reportedly claimed, "I argued with my mother who was nagging me," but "I assaulted her in a fit of anger, but I had no intention to kill."
The first trial sentenced A to 10 years in prison and ordered treatment and custody.

The first trial court stated, "It is difficult to even express the gravity of the crime, which is an inhumane act committed because the mother’s nagging made him angry," but "considering that the crime was committed in a state of diminished mental capacity, the sentence was set at 10 years in prison."
