Gwangju City Applies New Residual Land Criteria in Land Expropriation Decisions
[Asia Economy Honam Reporting Headquarters Reporter Park Seon-gang] Gwangju Metropolitan City announced on the 9th that it will apply new leftover land standards when making land expropriation decisions for leftover land.
Gwangju City will apply the "Reference Standards on Expropriation of Leftover Land and Compensation for Value Decline Losses," prepared by the Central Land Expropriation Committee on the 5th of last month, starting from the "2020 1st Local Land Expropriation Committee Decision" scheduled to be held next month, to appropriately resolve disputes related to leftover land between project implementers and landowners.
Leftover land refers to the land remaining after only a part of a contiguous parcel of land owned by the same owner is incorporated into a public project.
When a part of the land is incorporated into a public project, the loss is not limited to the incorporated portion but affects the entire land, resulting in a difference between the value acquired by the project implementer and the value lost by the landowner. Compensation for leftover land is significant in providing fair compensation for such losses.
The newly applied reference standards provide specific criteria regarding the loss of leftover land and the purchase of leftover land according to the "Act on Acquisition and Compensation of Land for Public Projects," which is expected to appropriately resolve disputes between parties.
