'Man in His 20s Who Raped 14-Year-Old and Produced Sexually Exploitative Material Receives Suspended Sentence on Appeal'
Sentence Reduced to Suspended Term from Three Years in Prison

A man in his twenties who raped a minor and produced sexually exploitative materials has had his sentence reduced to a suspended prison term on appeal.
According to legal sources on April 25, the Criminal Division 1 of the Changwon Panel of the Busan High Court, presided over by High Court Judge Park Gwangseo, overturned the original ruling that had sentenced Mr. A (25), who was indicted on charges including statutory rape of a minor, to immediate imprisonment. Instead, the court sentenced him to three years in prison, suspended for five years. However, the original orders requiring 40 hours of sexual violence treatment lectures and prohibiting employment at institutions related to children, adolescents, and people with disabilities for five years were upheld.
Previously, Mr. A was indicted in July of last year for raping Ms. B (14) at his residence in Uichang-gu, Changwon. During the same period, he also filmed the sexual assault of Ms. B with his mobile phone and, on several occasions, received specific photos of her body and produced multiple sexually exploitative materials or committed similar acts of rape. It is reported that Mr. A first met Ms. B on her birthday and, after gaining her favor with remarks such as "You are my ideal type," committed the crimes.
The first trial court sentenced him to three years in prison, stating, "Minors are individuals who require the formation of healthy sexual values, and their sexual self-determination rights must be specially protected. The law stipulates heavier penalties for sex crimes against minors than for those against adults." The court also explained that "the sentence was determined considering the victim's stated wish not to punish the defendant and the deposit of 20 million won." However, Mr. A appealed, arguing that the sentence was excessively harsh and unjust.

The appellate court stated, "Mr. A committed the crimes against a child or adolescent whose understanding and values regarding sex were not yet properly established in order to satisfy his sexual desires, which makes the nature of the crime particularly serious. The production of sexually exploitative materials causes significant social harm, and there is a risk that such materials could be distributed to an unspecified number of people, so strict punishment is necessary." However, the court also noted, "Mr. A did not use physical force during the crimes; he paid a certain amount of settlement money to the victim and her legal guardian and promised to pay additional amounts; he spent about eight months in detention, which likely gave him time to reflect; and the victim has expressed a wish not to pursue punishment." The court stated that these factors were taken into consideration in determining the sentence.
