Sejong Launches 'Collective Bargaining Support Center'... Publishes Revised Edition of '50 Questions and Answers About the Yellow Envelope Act'
Reflecting the Enforcement Decree of the Trade Union Act and Government Interpretive Guidelines
Law Firm Sejong announced on March 6 that it has launched the 'Collective Bargaining Support Center' and published the revised edition of '50 Questions and Answers About the Yellow Envelope Act' in order to proactively address labor-management conflicts following the implementation of the Yellow Envelope Act.
According to Sejong, the head of the Collective Bargaining Support Center is attorney Kim Jongsu, head of Sejong's labor group, who completed his doctoral coursework in labor law at Seoul National University and has extensive experience providing counsel and litigation services on various collective labor-management relations. Senior certified labor attorney Lee Seunghwan, who has directly handled complex multiple union labor relations at labor consulting firms and human resources teams of large corporations, will serve as deputy head. In addition, Kim Minseok, who served as Vice Minister at the Ministry of Employment and Labor, will participate as an advisor to provide guidance on overall labor-management relations.
Other experts in the labor field, including attorney Song Wooyong (40th class), attorney Yang Juyeol (1st bar exam), attorney Kim Jonghyun (2nd bar exam), and attorney Jang Jaehyeok (5th bar exam), will also take part. They will support all aspects of collective labor-management relations and industrial actions, such as establishing collective bargaining strategies, designing negotiation structures, and providing advice on union response strategies.
The Sejong labor group also published the revised edition of '50 Questions and Answers About the Yellow Envelope Act' the previous day, following the initial edition released in August last year. The revised edition has been newly organized to reflect the amended Enforcement Decree of the Trade Union Act, which is set to take effect on March 10, as well as the Ministry of Employment and Labor's final interpretive guidelines and a manual on negotiation procedures. It incorporates the Ministry's interpretive guidelines on the criteria for determining the status of principal employers and the subjects of labor disputes. In particular, with regard to the scope of recognition of principal employers, Q&As have been added for major negotiation topics such as occupational safety, work environment, employee welfare, working hours, work methods, and wages.

Kim Jongsu, head of Sejong's Collective Bargaining Support Center, stated, "Following the implementation of the Yellow Envelope Act, various issues are expected to arise in the field, including the determination of employer status in principal-subcontractor relationships, negotiation structures, and the scope of subjects for labor disputes.
