View original imageThe Central Labor Relations Commission has ruled that Shinseong Motors committed an unfair labor practice by excluding union members from duty assignments and refusing to engage in collective bargaining.
According to the Gwangju Jeonnam Branch of the Korean Metalworkers' Union on September 11, the Central Labor Relations Commission decided on July 28, during a retrial for relief from unfair labor practices requested by the union, that Shinseong Motors' actions constituted an unfair labor practice.
Shinseong Motors, as the management, excluded union members from three work meetings for wearing union vests and refused to engage in collective bargaining.
The union filed for relief with the Jeonnam Regional Labor Relations Commission, which recognized these actions as unfair labor practices. However, Shinseong Motors requested a retrial seeking to overturn the initial ruling.
The Central Labor Relations Commission determined that removing union members from work meetings for wearing union vests, which is a legitimate part of industrial action, constituted an unfair labor practice intended to interfere with union operations. The commission also found that citing busy work schedules or internal company events as reasons for not participating in collective bargaining did not constitute legitimate grounds for refusing negotiations.

The Gwangju Jeonnam Branch of the Metalworkers' Union stated, "We hope this ruling by the Central Labor Relations Commission will enable specially employed workers to engage in legitimate union activities," and added, "The management must comply with the commission's relief order and reinstate the union members."
