Withdrawal and Waiver of All Appeals in State Compensation Lawsuits
Against the Government for Cases Including Seongam Academy
The Ministry of Justice has decided to withdraw all appeals in the state compensation lawsuits filed by victims who were forcibly detained at the Brothers Home and Seongam Academy against the government. The ministry also decided to effectively forgo appeals in any first-instance rulings that will be delivered in the future.
On August 5, Minister of Justice Jung Seongho stated, "Based on the judgment that sufficient compensation must be provided to citizens whose human rights were violated due to illegal acts by the state, we have decided to withdraw and forgo appeals in order to more fully and promptly realize the relief of victims' rights."
The "Brothers Home case" refers to an incident in which more than 38,000 people were forcibly detained, leading to forced labor, assault, and harsh treatment, resulting in the deaths of over 650 individuals. Currently, 111 state compensation lawsuits filed by 652 victims of the Brothers Home are ongoing in court.
The "Seongam Academy case" involved the forcible detention of over 4,700 children, who were subjected to forced labor, assault, and other harsh treatment, resulting in the deaths of at least 29 individuals and the disappearance of many others. It is also referred to as the "child version of the Brothers Home case." Currently, 42 state compensation lawsuits filed by 377 victims of Seongam Academy are ongoing in court.

The Ministry of Justice explained that, until now, it had appealed the state compensation lawsuits related to the Brothers Home and Seongam Academy, citing the need to establish consistent compensation standards. However, after the Supreme Court dismissed the appeals (non-substantive dismissal), the ministry determined that the suffering of the victims should not be prolonged by further litigation and thus made this decision.
