Yoon Suk-yeol's Legal Team Files to Suspend Compulsory Execution of Martial Law Compensation Ruling
The legal team of former President Yoon Suk-yeol (65, Judicial Research and Training Institute Class 23) has filed a petition with the court to suspend compulsory execution of the first-instance ruling that ordered compensation for emotional damages to citizens affected by the December 3 Martial Law.
On July 29, Yoon's legal team submitted a request to suspend compulsory execution of the first-instance verdict, which ordered the payment of 100,000 won per person in compensation. This move follows their appeal against the initial ruling and is seen as an effort to prevent provisional enforcement of the verdict before it becomes final. The case regarding the suspension of compulsory execution will be reviewed by the Civil Appellate Division 8-3 of the Seoul Central District Court (Presiding Judges: Shin Younghee, Jung Injae, Kim Kihyun).
Previously, on July 25, Presiding Judge Lee Seongbok (65, Class 16) of the Seoul Central District Court Civil Division 2, ruled in favor of the plaintiffs in a damages lawsuit (case number 2024Gaso120790) filed by 104 citizens against former President Yoon, ordering him to pay 100,000 won per person.
The court also ruled that provisional enforcement was permitted at that time. Provisional enforcement allows for the compulsory execution of compensation payments even before the verdict becomes final. Although the general principle is that compulsory execution can only proceed after a verdict is finalized, provisional enforcement is sometimes allowed to ensure the prompt realization of rights.
If the court accepts the petition to suspend compulsory execution, provisional enforcement will not be possible until the deadline set by the court. If the petition is denied, the possibility of provisional enforcement remains in effect.
