The previous day, the Supreme Court had initially assigned Lee's case to the Second Division, a four-justice panel consisting of Justices Oh Kyungmi, Kwon Youngjun, Um Sangpil, and Park Youngjae. However, within about two hours, Chief Justice Cho referred the case to the en banc panel.
