An employee of a medical device sales company who assisted with implant procedures without being a medical professional, and the dentist who instructed this, were fined.
According to Yonhap News on the 30th, the Uijeongbu District Court Criminal Division 6 (Judge Hwang Hyun-chan) sentenced dentist A, who was indicted for violating the Medical Service Act, to a fine of 10 million won, and employee B of the medical device sales company to a fine of 7 million won.
A performed implant procedures twice in September and October 2022 at his dental clinic in Uijeongbu City. At that time, he had B, who was not a medical professional, assist with medical instruments such as detaching and exchanging the handpiece device and assisting with direction during the procedure.
The court stated, "Defendant A had implant company employee B perform medical acts such as detaching the handpiece device, and B, who was not a medical professional, performed medical acts, which is a serious offense." It added, "However, considering that the patients who received the implant procedures did not suffer any particular harm or aftereffects, and that there was no continuous violation beyond the two indicted instances, these factors were reflected in the judgment."
