The Joint Investigation Headquarters (Joint Headquarters), which is investigating the '12·3 Emergency Martial Law' incident, has requested an arrest warrant for President Yoon Seok-yeol on charges of insurrection, as well as a search warrant for the presidential residence. However, they plan to carefully review and decide on the response if President Yoon refuses to comply with the execution of the warrants.
On the 30th, a representative of the Special Investigation Team of the National Police Agency's National Investigation Headquarters stated, "At around midnight today, the High-ranking Officials' Crime Investigation Division (HOCI) filed an arrest warrant request for President Yoon Seok-yeol at the Seoul Western District Court." The official explained the reason for the arrest warrant request, saying, "President Yoon previously ignored three summons requests from HOCI, and on the 29th, he was absent without submitting any separate statement."
Additionally, the Joint Headquarters reported that regarding the failed attempt to search the presidential safe house due to the Presidential Security Service's disapproval, they sent an official letter to President Yoon's side requesting voluntary submission of related materials. A police official said, "We asked them to clarify the specific reasons for refusing the search and sent an official letter on the 30th requesting voluntary submission of investigation-related materials."
The Joint Headquarters holds the position that if the arrest warrant is issued, President Yoon must comply with its execution even if he appears voluntarily. A police official emphasized, "If he appears before the arrest warrant is issued, an investigation can be conducted, but once the warrant is issued, it must be executed."
Regarding concerns that the execution of the arrest warrant may be impossible due to the Presidential Security Service's refusal of entry, the official said, "Usually, if the location is specified, the warrant can be executed by hiding inside the residence or by stakeout," and added, "We recognize that various variables may arise during the execution of the warrant, so we plan to respond after thorough review following the issuance."
Furthermore, in response to President Yoon's side's claim that HOCI lacks jurisdiction over insurrection charges and that the Joint Headquarters has no legal basis, the police dismissed it, saying, "There is no need to respond to that." A police official stated, "We have been investigating suspects related to insurrection so far, and Commander Moon Sang-ho of the Defense Security Command has been detained," drawing a clear line by adding, "We see no reason to respond to or refute the legal basis."

Meanwhile, it was confirmed that the Special Investigation Team also sent a second summons request to former Acting Prime Minister Han Duck-soo on the same day. Han is the first among the attendees of the Cabinet meeting to receive a second summons request from the police. In addition, the police are currently investigating 45 active-duty military personnel as suspects in connection with the martial law incident.
