Cancellation Decision of Disposition for Workplace with Industrial Accident Occurrence
An administrative adjudication result has ruled that it is unfair to designate the last workplace as the industrial accident applicable workplace without considering the working days and type of accident of the injured worker.
On the 10th, the Central Administrative Adjudication Committee of the Anti-Corruption and Civil Rights Commission announced that it had canceled the decision by the Korea Workers' Compensation and Welfare Service, which designated the final workplace as the industrial accident applicable workplace without considering the worker's employment history.
The Korea Workers' Compensation and Welfare Service stated that it was difficult to clearly identify the workplace where the accident occurred among the workplaces where the worker had previously worked, and imposed the collection of industrial accident insurance benefits on the final workplace. This was because the worker developed degenerative knee osteoarthritis while working as a plumber at the final workplace.
The Anti-Corruption and Civil Rights Commission judged that such a disposition was unreasonable, considering that the worker worked only 71 days at the final workplace and the remaining 319 days at other workplaces. It also found it difficult to see whether the Korea Workers' Compensation and Welfare Service conducted sufficient review to specify the industrial accident applicable workplace.

The Commission stated, "There is a need for the Korea Workers' Compensation and Welfare Service to establish reasonable criteria based on laws and regulations for determining the industrial accident applicable workplace," and added, "We will strictly scrutinize erroneous dispositions by administrative agencies to ensure administration that the public can trust and rely on."
