Man in his 30s convicted for sending 'obscene messages' to female user during game
40-Hour Completion Order for Sexual Violence Treatment Program
Guilty Verdict After Formal Trial Request
Same Outcome in Appeal Trial
The Chuncheon District Court Criminal Division 1 on the 4th dismissed the appeal of Mr. A (34), a man in his 30s who was indicted for obscenity using communication media under the Sexual Violence Punishment Act, upheld the original verdict, and ordered a fine of 2 million won and completion of 40 hours of a sexual violence treatment program. The court explained the reason for dismissing the appeal, stating, "The original judgment is justified."
Mr. A was summarily indicted last June for repeatedly sending obscene messages to female user Ms. B during an online game, causing sexual shame and disgust. Mr. A filed a formal trial in objection to this but was found guilty in the first trial.
The first trial court judged Mr. A guilty, citing that despite other users' objections, he used vulgar expressions along with Ms. B's real name. Mr. A appealed, claiming innocence, but the appellate court judged that Mr. A's actions clearly sexually mocked and hurt the victim.

The court emphasized that Mr. A's remarks were sufficient to cause humiliation and that Ms. B's ID included her real name, indicating he recognized her as a woman. Furthermore, considering that Mr. A used sexually derogatory expressions just five seconds after the game started, the court concluded that his actions were intentionally aimed at causing sexual shame, not to criticize Ms. B's gaming skills or attitude.
