"Forced Hospitalization in Psychiatric Ward After Divorce Demand" Story of a Woman in Her 30s Shared
A story has emerged about a woman in her 30s who was forcibly hospitalized in a psychiatric hospital after requesting a divorce, following a protective hospitalization application filed by her husband and mother-in-law.
On the 19th, YTN reported that Ms. A, a woman in her 30s, was forcibly taken to a psychiatric hospital on December 17 last year and was confined for over two months without knowing the reason, only to be released after filing a petition for personal protection relief.
The incident occurred about a week after Ms. A informed her husband, with whom she had been arguing over child-rearing issues, of her intention to divorce. Suddenly, private emergency medical technicians barged into her home and tried to take her to a psychiatric hospital. Police officers who responded to Ms. A’s report were present at the scene but could not intervene. The emergency medical technicians explained that the commotion occurred during the 'protective hospitalization' process, which had been consented to by legal guardians. Ultimately, Ms. A was forcibly put into a vehicle and taken to the psychiatric hospital.
Under the Mental Health Act, protective hospitalization requires an application from two legal guardians and a diagnosis from a psychiatric specialist indicating the need for hospitalization. The applicants for Ms. A’s hospitalization were her husband and mother-in-law. At the time of admission, Ms. A’s hospital medical records stated that hospitalization was necessary due to various symptoms such as hallucinations, delusions, agitation, and depression. However, Ms. A claimed that she never received psychiatric treatment during the admission process. She also stated that she had never suffered from any mental illness before and had worked steadily at the same job for nearly 13 years until taking parental leave.
As a result, Ms. A was confined in the hospital for over two months without understanding why, having to take psychotropic medications. After her phone and external contacts were cut off upon admission, she was able to contact an acquaintance and file a ‘petition for personal protection relief’ with the court, which eventually led to her release. The petition for personal protection relief is a system that allows individuals confined or detained in various medical, welfare, detention, or protective facilities to request relief if their personal freedom is unlawfully restricted, such as through illegal detention.
