A story has emerged about a man whose wife, an ardent fan of a male celebrity, fell in love with a man who resembled that celebrity and even gave him a large sum of money.
On the 11th, YTN Radio's 'Attorney Jo In-seop's Counseling Center' aired a story from a man who is experiencing conflict due to his wife's fan obsession. The protagonist, Mr. A, who works at a security company, stated, "I met my wife, who was an avid fan of a male celebrity, while working as a bodyguard for celebrities. We fell in love and eventually got married."
Mr. A's wife reportedly continued taking photos of the celebrity with a camera even after their marriage. Since she earned a considerable income by selling these photos to other fans, he could not ask her to stop.
Mr. A said, "I joined a large security company and was often busy with overseas business trips, so I couldn't see my wife frequently. Feeling sorry about this, I bought expensive cameras and lenses at duty-free shops whenever I traveled abroad and gave them to her as gifts."
However, he revealed, "While looking through the photos my wife took with the camera, I discovered that she had an affair with a man who resembled the celebrity. When I confronted her, she said, 'He looks so much like the celebrity that I couldn't help falling in love,' and that she canceled a large savings account and gave the money to that man after he said, 'Let's get divorced and remarry each other.'"
Mr. A expressed, "I want to get a divorce, but I don't know what to do about the money given to that man, and I want to include the expensive camera I bought for my wife in the property division," requesting advice on how to resolve the issue.
Attorney Kim So-yeon suggested, "Along with filing for divorce, it is necessary to file a claim to cancel fraudulent acts to preserve the right to property division against the third party involved." She speculated, "It seems the wife intended to hide assets in anticipation of divorce," and explained, "If a spouse knowingly gifts assets, undermining the other spouse's right to property division, the gift can be canceled and the money restored to its original state."
However, she added, "This applies if the wife is the one who must provide property division. If the wife is the one entitled to property division, Mr. A does not have a right to preserve a claim for property division."
So, can the camera Mr. A bought for his wife be included in the property division?
Attorney Kim said, "The camera can be considered marital property subject to division, but unlike vehicles registered with public institutions, it is not easy to specify." She added, "You can apply for a property disclosure request and use a property disclosure decision to identify movable property worth over 1 million won per item. However, even in this case, the spouse may not answer honestly."
