Utilized for Establishing Pan-National Technology and Industry Strategies
The Korean Intellectual Property Office (KIPO) will be able to prevent technology leakage and support corporate research and development by analyzing and utilizing patent information.
On the 31st, KIPO announced that the draft bill for the "Act on the Management and Promotion of Utilization of Industrial Property Information" (hereinafter referred to as the Promotion Act), which enables extensive analysis and utilization of industrial property information such as patents, trademarks, and designs, has passed the Cabinet meeting.
Currently, KIPO holds 580 million patent information records worldwide, including data on companies, researchers, and the latest industry technology trends. Patent information is classified as core information that can be strategically used to prevent duplication in research and development, analyze major issues related to industry, economy, and security, and establish national policies and corporate management strategies.
However, until now, there has been no legal basis to utilize patent information, which has limited the discovery and analysis of national strategic technologies, prevention of technology leakage, and use of patent information for corporate technology development.
The Promotion Act was enacted to resolve these limitations and is significant as it will provide the legal foundation to establish a system for strategic analysis and utilization of patent information in the future.
The Promotion Act includes key elements such as ▲ provision of industrial property information for national security and prevention of technology leakage ▲ analysis and utilization of industrial property information for technology and industry support ▲ establishment of a legal basis for patent information-related projects.
Through this, KIPO emphasizes that it has become possible to build an inter-agency cooperation system for technology protection by analyzing patent information under application and providing the results to relevant government agencies.
It is also expected that patent information, including inventor disclosure information, will be collected and organized, then processed and analyzed in a timely manner to be utilized in nationwide research and development as well as in the formulation of technology and industry-related strategies.
KIPO plans to establish the legal basis for building patent information systems and databases (DB) and informatization projects to comprehensively and systematically manage patent information while increasing its utilization.
Following the passage of the Promotion Act at the Cabinet meeting, it will be promulgated on the 6th of next month. Subsequently, detailed regulations on the use and provision of industrial property information and the content and procedures for providing industrial property information for national security purposes will be enacted through enforcement decrees, and the Act is scheduled to be implemented from August 6 of this year.

Kim Si-hyung, Acting Commissioner of KIPO, said, “Through the enactment of the Promotion Act, patent information will be actively utilized for fostering and protecting national strategic technologies, and this will serve as an opportunity to enhance the domestic industrial, economic, and security governance capabilities based on patent big data.”
